Kharkov inhabitants require freedom for the five Heroes of Cuba

On April, 30, 2010 in the Institute of microbiology and immunology named of Mechnikov there was a conference and day of the Cuban cinema took devoted to the theme of of five Cuban heroes, condemned in the United States for their selfless work in favor for prevention of terrorist acts against Cuba, planned by American mafia organizations.
This meeting was organized by Kharkov province association of «Friendship Ukraine - Cuba» (leader, director of institute, professor, doctor of medical sciences, academician I.L. Volyanskiy), Kharkov province committee «For freedom for the five Cuban heroes» (co-ordinator Y.N. Karachevtsev, editor of Ukrainian newspaper «Contemporaneity and objective t»). The activists of Communist party of Ukraine, Progressive socialistic party of Ukraine, National-bolshevic party of Ukraine, public organizations: Allukrainian union of soviet officers, «For renewal of the USSR», research journalistic organization «Altruist» and others.
Participants watched a movie «Mission against terror». After discussion there was signing of collective appeal to the address of President of Ukraine, Supreme Soviet of Ukraine, Ministry of education and science of Ukraine, Embassy of the USA in Ukraine, president of the USA Barrack Abama, Commission of UNO on human rights (on procedure 1503). In appeal it was stressed about the double standards of the USA in the domain of defence of human rights and fight against international terrorism. It was underlined that State Soviet (D of Russia had condemned the USA because of illegal arrest of Five Cuban heroes. And parliament of Iran acknowledged CIA and army of the USA to be terrorist organizations. In a letter there were requirements to the Supreme Soviet (Rada) and president of Ukraine to acknowledge political nat of the case of Cuban five and illegality of arrest, to tear diplomatic, economic and any other relationships with the USA until the moment of liberation of Gerardo, Ramona, Antonio, Fernando and Rene. The signers demanded from Ministry of Education of Ukraine add school and higher educational establishments History and Law textbooks with information about the case of the five as an example of gross violation of human rights and double standards of government of the USA. These appeals were signed by deputy of Kharkov province soviet from the block of Natalia Vitrenko «N opposition», a responsible secretary of trade union «Confederation of Labour of Ukraine» of V.D. Tsimbalyuk, 2 secretary of Kharkov province committee of Young communist organization (komsomol) V.O. Vasilevskiy, chief of Kharkov commissioner on defence of rights of political prisoners created under public organization «Labour Khar'kovshchina» A.T. Bibik, Chairman of Kharkov province anti-fascist committee V.A. Mel’nikov, Chairman of the Soviet of veterans № 179 of Kharkov A.D. Galitsa and other activists of Kharkov organizations.
The cards to the president Barrack Abama, where 10 Nobel laureates require immediate freedom for the Five Heroes of Cuba were also signed and sent.
On meting there were placards with the image of Gerardo, Ramona, Antonio, Fernando and Rene, made in Cuba (Editora politica) and in Belgium by of Iniciativa Cuba Socialista (www.cubanismo.net), placard with the image of Che and actions of solidarity with Cuba in Ukraine, made by Allukrainian «Che Guevara», and placard with the image of Fidel Castro and Hugo Chaves» with a signature: «They did revolution. But you?», made by Kharkov communists.
The participators have got the texts of appeal, and also allukrainian newspapers «Contemporaneity and objective », where the reflections of Fidel Castro «Reform of health protection of the United States» (March, 24, 2010), requirements of 10 Nobel laureates to free 5 Cuban heroes, announcing about conducting European meeting of solidarity with Cuba in Sofia (Bulgaria), and also announcing on treatment on Cuba, Kievan firm CUBA-MED (leader is doctor-consultant V.V. Gnedyh, info@cubamed.com.ua). Appeal
The USA declare that they contest with terrorism. But actually, facts demonstrate the opposite opinion. Being based in the USA criminal groupments from 1959 for 1997 carried out on Cuba 5780 acts of terrorism, which caused 3,5 thousands deaths among Cubans. More than 2 thousands of Cubans became invalids because of these terror acts. Therefore 5 citizens of Cuba of Rene Gonsales Sekhverert, Ramon Labanino Salazar, Antonio Gerero Rodriges, Herardo Ernandes Nordelo, Fernando Gonsales L'ort inculcated in terroristic organizations based in the USA, and passed to the government of Cuba information about preparing acts of terrorism. Their activity in Florida allowed to prevent more than 170 assassinations which were planned by the counter-revolutionary Cuban emigrants against Cuba. Government of Cuba passed the rich information collected by these people to the authorities of the USA, and ask them to undertake measures against international terrorists who based on American territory. But FBI, despite officia promises and hypocritical statements about its fight against international terrorism, took advantage of this information quite in other aims – on September, 12, 1998 it arrested those, who collected this information, and terrorists remained free. Among these terrorists were and those, who developed and carried out the act of terrorism against towers-twins in New York. In 2001 a court in Miami sentenced fighters with international terrorism of Gerardo, Antonio, Ramon to life imprisonment, and Fernando and Rene by 19 and to 15 years, accordingly. The next day after the pronouncement of sentence of court parliament of Cuba appropriated these citizens with a high governmental rank Heroes of Cuba.
For comparison, three weeks ago judge Lenard in that Miami condemned 4 terrorists, which were caught with a weapon, explosives, and had a whole plan of explosions of social objects in New York, they were condemned on 6, on 7, on 8, on 9 years. There are a lot of such examples. The same was with the spies from Israel, who passed thousand documents from White Home to the government of Israel, and they were not even punished. Or Sant'yago Guama, one of the Cuban leaders of mafia organizations in by Miami, he was caught with a weapon and live ammunitions, in amount more than 2 tons, and he was literally imprisoned for a few months. And there are a lot of such examples, for instance Lewis Posada Cerriles.
It is wide known that on October, 6, 1976 in mid air after flight from Barbados (Antil'sky islands) the Cuban passenger airplane was blown up above the sea. 73 men were killed as a result of this act of terrorism, among them the youth combined team of Cuba on fencing, which have won all golden medals on the Ibero-America games in Caracas in that time. Terrorists were very quickly caught. They were two Venezuelans, who got off from the airplane in Barbados, preliminary putting bombs under seats and in the toilet room. However, they were only performers. They were guided by organizers of this crime - former citizens of Cuba: Orlando Bosh and Louis Posada of Carriles. After revolution they abandoned Cuba and as agents of CIA they conduct irreconcilable terrorist war against Cuba for almost 47 years. Orlando Bosh was sheltered by the USA. And although the Congress of the USA declared him to be a terrorist, Bush-older complimented him status of inviolable person with his presidential decree. He freely goes for a walk on streets of Miami and constantly gives interview on television.
Posada of Carriles went out from prison in Panama in 2004. In 2000 he was condemned by the Panamanian court because of «threat to public safety» (he was caught with some pounds of explosive C-4, which he intended to purpose to kill Fidel Castro in the apartment of university, where the meeting of hundreds of the Panamanian students with him had to take place). He was forgiven by president of the country Mireiya Moskoso a graft before few days prior of term of her presidential authorities.
In 1985 Posada of Carriles with the help of the USA accomplished escape from Venezuelan prison after jailing there for eight years. the whole series of acts of terrorism on Cuba were organized exactly by him in 1997. In the same time the United States refuse the Venezuelan government, which on June, 15, 2005 sent a query to the State department of the USA with a requirement to give out Louis Posada of Carriles for a court for the act of terrorism of 1976 when the explosion of the passenger Cuban airplane took away lives of 73 persons, because he avoided punishment accomplishing escape from prison. The query of Venezuela accounts for 520 pages of documents, expressing essence of against Posada and produce numerous proofs against the agent of CIA with experience. Officials of Venezuela name Posada Carriles as «Ibero-American Ben Laden» his well known participation in the numerous acts of terrorism, mostly directed against Cuba.
Public prosecutor, who presented the government of the USA, and was also a public prosecutor in 2001, openly said in the speech in the hall of court, that this is political case. Even Judge Lenard attacked «How can you talk so, if you talked in 2001 that there is espionage?». Public prosecutor talked also in a court that «In the world there is a lot of noise this case». But actually it is not noise, this is wide wave of protest of all solidarious people of all over the world. It is pressure of solidarity organizations, governments, nations of the world, people. They press on the USA government, and public prosecutor acknowledged it. Openly in the speech. And in same queue, judge Lenard acknowledged that they did not have accomplished espionage, because passed no information, but they wanted to do that. And despite that statement, she sentenced them to the strongest punishments, that violates legislation, because the punishment for a crime attempt is less heavy than the crime itself. New punishments also to be unfair, because there are no proofs, that they accomplished something against safety of the USA. One from judges on territory of Miami called the office of public prosecutor to deliver such proofs. But nobody gave them to the court because there are no proofs. During the court trial in 2001 they talked that there were secret documents, volumes which nobody saw until now. That five were condemned on the basis of supposition that such documents, disrobing espionage, exist. Bthey are not simply present in reality, and they could not exist. According to acknolidgments of high-up generals and director of military base which is in Tampa there can not be such documents, because the condemned had no access to secret information. They only passed information about the plans of ultra-right Cuban organizations on accomplishing raids against Cuba.
The Appeal court (which passed judgement in 2001) decided a year ago that three from 5, namely Ramon, which was condemned on a life term plus 18 years of imprisonment, Antonio Gerero, which was condemned on a life term plus 10 years, and Ferardo Ernades, which was condemned on 19 years of imprisonment, that their punishment exceeded their sentence, exceeded those violations which they accomplished allegedly. And it delivered the case to the court of Miami in order to reduce sentences. To two, from 5, a court decided that Gerardo who was condemned on a life term, that his sentence must be revised. And also Rene Gonsales, who was condemned for 15 years. And defence passed case to the investigation by Supreme Court, which did not accept case, renounced to investigate, and returned back.
Quite recently on October, 13 in Miami in the hall of the same court in presence of the same judges, on behalf of government the matter of Antonio Gererro was revised. On October, 13, the sentence of Antonio who was condemned on a life term plus 10 years, his sentence was lowered and he was sentenced to imprisonment for a term of 21 years plus 10 months. Although the office of public prosecutor asked 20 years. But the court has chosen the strongest punishment.
On 8 December, 2009 at 10 o'clock on Miami time, the case of Ramona Labonino and Fernando Gonsalesa was revised. Ramona Labonino, who was sentenced on a life term plus 18 years, was sentenced to the term of 30 years. Fernando Gonsalez, who was sentenced on 19 years, had reduced term to 17 years.
It is not allowed for the wives of Gerardo and Rene to arrive on territory of the USA. This prohibition fully violates international laws and rights of any defendant on territory of the United States of America. As it is pointed in criminal-executive code of USA, the prison must do everything to draw together a prisoner with natives. It one of main moments to recover his social qualities. However in the case of the Cuban 5 USA of refuse to carry out the laws. Adriana, spouse of Gerardo, who was condemned for 2 lifelong term, and spouse of Rene Gonsalez, who was condemned for 15 years, their wives more than 11 years can not visit husbands, because the government of the USA does not give visas them. It is one of the most rough violations.
We must reach our purpose. It is returning 5 Heroes to Cuba. It can be decided by the legal system or by forgiveness from the side of president of the USA. Due to the Constitution of the USA he can do it. Bush-younger forgave terrorist Orlando Bosh, one of those, who planned the explosion of the Cuban airplane in 1976. Not looking on that Congress of the USA acknowledged that he was the real terrorist. As forgave other terrorists.
On December, 2, 2009, we knew that the president of Ukraine had handed by means of the ambassador the high Ukrainian order to Linkol'n Dias Balart, the Cuban-origin congressmen of Congress of the USA. To understand who is he, it is necessary to consider history of his family. Beginning of the clan of Dias Balart was when two brothers Dales, one of whose was Alan Dales was the first director of CIA, and on behalf of government of the USA entered in a contact with Nazi. His elder brother was U.S. Secretary of State. From the top clans of the USA. Grandfather of Linkol'n Rafael' Dias Balart – senior practiced law on Cuba United Fred Company in 1920 – 1930 – s Dales were in composition of the main proprietors of this company which on Cuba had more than 100 thousand of hectares of ground, bought up by using corruption methods for the cost of a 1 cavalry (14 hectares) for 8 cents in the beginning of past century. Raphael Balart was their advocate. Senior from Dales was in part of owners of United Frut Company. Rafael' Dias-Balart (junior), being a student, was the leader of Batista students in Havana. And at the last government of Batista he reached to the minister of justice. When on Cuba more than 20 000 young people, political, trade-union leaders, were destroyed. And he was the minister of justice from 1952 to 1958. Raphael Diasa Balart – junior has two sons: Linkol'n and Mario, a godfather was a dictator Batista. When Batista in a flash left after victory of Revolution, Raphael Dias-Balart - the junior collected the things also. He was one of those, who stole 450 million dollars from the state treasury and flew away in Miami. He was one of the first, which created counter-revolutionary organization in by Miami under the name «White Rose» which, one of the first organized assassinations against Cuba, and fed up counter-revolution into Cuba. Linkol'n Dias Balart on Decembers, 2 an order. Linkol'n and Marias Dias Balart – both the congressmen of the USA during many years, tied to the ultra-right clans of the USA. But in addition, they present leadership of ultra-right Cuban immigrations on territory of the USA. Gektor Peskvera, who in 2001 was the chief of FBI in Miami called exactly to them, and they gave an order on the capture five Cuban heroes, Peskvera did not phoned to the authority, but phoned Linkol'n and Maries Balart and other Cuban congressmen who ultra-right position against Cuba. The article issued out recently, that for this year the congressmen of the USA received for this year more than 11 millions to break any steps on the removal of blockade against Cuba. And among them a most high value of money was got by Linkol'n Dias Balart. He is a leader on lobbying blockade of Cuba in Congress of the USA. In 1970th of United Fred Company united with the company of clan of Bush and created United Brand. Now United Fred Company bore so much dirt in all of Latin America, that it had to changed its name. Now it is called «Conchita Brand». Its main tentacles are in , where now the USA have 2-nd on a scale military help, and are in a position to wage war on all of the Ibero continent, except for Earth of Fire. And in Honduras is the second main persistent place of «Conchita Brand» and «Union Brand», where all democratic rights for people, president, all rights which can be, are now violated, are broken by the government of the USA. And Linkol'n Dias-Balart has connection with ultra-right circles and oligarchs of Honduras and Latin America. The press holds back about that and does not know in general what has happened. The official pretext for handing this high order was that he helped treatment 9 Ukrainian children in the clinics of the USA. While Cuba cured more than 25 000 Ukrainian children-chernobyltsy. Besides there were attempts to close this program under ruling of Yushchenko, that as if USA will continue to treat of our children.
In connections with that arrested people are appropriated with state rank of Heroes of Republic Cuba, and the government of Cuba officially declares that the detained men a law-enforcement mission in accordance to the norm of international law, and the parliament of Cuba – Assembly of n power conducted an extraordinary session and appropriated these citizens with the highest governmental reward Heroes of Cuba on the next day after the pronouncement of sentence, we consider that jailing of Gerard, Ramon, Antonio, Fernando and Rene in the places of imprisonment is illegal because the question about guilt of prominent figures of the state must be decided on the international level or in their country (in Cuba) according to the procedure of bringing to responsibility diplomatic workers, that straightly ensues from principle of analogy of right, with immediate liberation of prisoners, but not at the local level by the court of the first instance.
On May, 27, 2005 the Working group on illegal detentions of Council of human rights of UNO, decreed that court and sentences of five Cuban citizens were illegal.
On August, 9, 2005 Appeal Court of 11th district of Atlanta abolished the sentence of Miami court concerning five Cubans, and declared it to be illegal. The other questions of this judicial case were decided by Appeal Court to leave for the consideration of three judges: to secrecy with the purpose of accomplishing of murder, to secrecy with the purpose of accomplishing of espionage, violations on a court with the use of secret information, et al.
In the decision which accounted for 93 pages, high judges acknowledged that "prejudices against Cuba dominated in society and in rulings organs and press before and during the judicial process were combined, creating a situation which made impossible just examination of the case of the five Cubansl".
Many parliaments of different countries of the world, including state Duma (Soviet) of Russian Federation (unanimous decision dated February, 21, 2007), more than 6000 representatives of world intelligentsia, 10 nobel laureates support the requirement to free five Cubans. In 80 countries of the world more than 250 Committees are created in of the political prisoners of USA Ramon, Antonio, Fernando and Rene, Gerardo. Fact of confession of innocence of these Cuban anti-terrorists in 80 countries of the world confirms their innocence and political of trial and sentence of the American courts due to these men.
During precourt investigation these persons were contained in punishment cells for more than 17 months, even that due to the laws of the USA maximal maintenance can not exceed 2 months. During 17-monthly detentions in punishment cells they refused these Cuban citizens in good food. Unhuman conditions during detaining prove the use of physical, moral, psychical and psychological pressure, tortures, humiliation of human dignity respecting to these persons. Refusing them in meetings with the consul of Cuba, American power violated the common norms of international law. Forbidding fore more than 10 years for Rene and Gerardo to meet with their wives and children and all of prisoners to get and send letters for long time, the American court and investigators showed the antihumanity and antihumaneness.
We require from Supreme Rady Ukrainy and president of Ukraine:
To adopt the decision and appeal to the Commission of on human rights UNO, European committee against tortures to make these international organizations accept all necessary measures for confession of actions of authorities of the USA in regard to Gerardo, Ramona, Antonio, Fernando and Rene as illegal, and as such, which violate norms of international law. In this connection we ask to adopt the decision and appeal to the government of the USA with the requirement of substantial improvement of conditions of life in prisons, and also immediate liberation of citizens Gerardo, Ramon, Antonio, Fernando and Rene. The political detainers of the USA of Gerardo, Ramon, Antonio, Fernando and Rene fought against terrorism, including those terrorists who inflicted enormous harm to the United States of America, and violence Cubans is absolutely ungrounded, has no logic, therefore in this situation justifying thing would be forgiveness of these innocent people by the president. Absence of such actions from the side of the president of the USA confirms existent opinion in the world that army of the USA, CIA and other the public organs of the USA assist terrorism, and on territory of Iraq and Afghanistan behave themselves as terrorists. On October, 1, 2007 that was confirmed by the parliament of Iran, which declared the decision of parliament that the army of the USA and CIA are terrorist organizations.
We ask you to recognize that the USA violated and violate the following rights of the Cuban five:
1. Right for freedom and personal inviolability, - articles 3, 9 of the General Declaration of Human rights.
2. Right for the respect of honor and dignity, inalienable right not to be tortured, and applied to unhuman or humiliating dignity manners, - article 5 of the General Declaration of Human rights.
3. Right for freedom of the thought, for freedom of expressing one’s opinions. In connection with that we demand to recognize that Gerardo, Ramon, Antonio, Fernando and Rene are the political prisoners of the USA. And that strictness of jail conditions and severity of sentences are caused by one factor – will of the power of USA to defile and humiliate socialist choice of Cuba and its nation, - articles 7, 18, 19 of the General Declaration of Human rights.
4. Right for just court consideration and effective protection of his rights, - articles 8, 9, 10 of the General Declaration of Human rights.
5. Right for meeting with close relatives – Olga Salanueva and Adriana Perez – wives of Rene Golsalez and Herardo Hernandez can not visit their husbands because the USA refuse to issue visas.
In connection with the foregoing we ask you to adopt the proper decisions and break all diplomatic, economic, soldiery, political and other relationships with the USA and to turn out the ambassador of the USA in Ukraine from Ukraine until liberation of the illegally condemned political detainers Heroes of Cuba, prominent fighters with world terrorism. We ask you to appeal to the President of the USA, Congress of the USA with the requirement to immediately free Gerardo, Ramon, Antonio, Fernando and Rene. We ask you to appeal to the Organizing committee on the Nobel prices with the request of rewarding of Gerardo, Ramon, Antonio, Fernando and Rene with Nobel Price of .
We require the Department of education and science: to start studying in schools and higher educational establishment the materials of this case as an example of fight against international terrorism of the Cuban patriots, and double standards of the USA concerning the fight against terrorism and observance of human rights during the courses of History and Law.

We require from the embassy of the USA in Ukraine:
To inform the government of the United States and president of the USA about our indignation concerning the double standards of the United States on question of the fight against terrorism and violation of human (illegal arrest and jailing in prisons of the USA, limitation of the right for meeting with relatives and other) rights and give visas for Olga Salanueva and Adriana Peres - the wives of Rene Gonsalez and Herardo Hernandez to visit their husbands, sufferings in prisons of the USA.
We require from the president of the USA:
To free immediately Gerardo, Ramon, Antonio, Fernando and Rene and return them to Cuba. To give visas Olga Salanueva and Adriane Peres – the wives of Rene Gonsalez and Herardo Hernandez to visit their husbands, sufferings in prisons of the USA.

We require from Commission on human rights of UNO:
you to recognize that the USA violated and violate the following rights of the Cuban five:
1. Right for freedom and personal inviolability, - articles 3, 9 of the General Declaration of Human rights.
2. Right for the respect of honor and dignity, inalienable right not to be tortured, and applied to unhuman or humiliating dignity manners, - article 5 of the General Declaration of Human rights.
3. Right for freedom of the thought, for freedom of expressing one’s opinions. In connection with that we demand to recognize that Gerardo, Ramon, Antonio, Fernando and Rene are the political prisoners of the USA.
